Rule 53
Study Leave
(1) Employees who are nominated or selected to study on a domestic or foreign scholarship received by the Ministry or the Ministry on matters useful and necessary to the service may get study leave throughout the study period.
(2) The employee will get study leave once or several times throughout the service period for a maximum of six years. However, the same employee will not be given study leave again after three years of returning to service after completing a study.
(3) Notwithstanding anything written in sub-rule (2), an employee who has been nominated and taken study leave for the purpose of study shall not be granted additional study leave for the purpose of studying additional subjects or obtaining an additional degree and shall not be granted extraordinary leave.
(4) Employees will receive full salary while on study leave.
(5) By-laws for employees who go to study on private endeavors with the prior approval of the Government of Nepal on matters useful and necessary for the relevant subgroups
According to (2), study leave can be granted. Notwithstanding anything contained in sub-rule (4), employees on such study leave shall not be paid.
(6) An employee shall not be entitled to study leave without having served at least one year in the most remote areas and two years in the remote areas in the post he/she is holding for three years. However, in the case of not being able to serve in a very remote or remote area due to lack of position or rank or office, there will be no hindrance in giving study leave to such employees even if they have not served in the mentioned area. Explanation :- According to this regulation, if the temporary service period done by an employee is counted as permanent service period, then the temporary service period will also be counted for the purpose of this sub-rule.
(6a) Notwithstanding anything contained in sub-rule (6), employees selected for postgraduate studies conducted by universities or educational institutions within Nepal designated by the Government of Nepal have completed a minimum period of two years with at least one year of service in remote areas or two years in remote areas. If so, there will be no hindrance in granting study leave to such employees.
(7) If the Government of Nepal nominates and appoints any employee to receive training necessary for the implementation of any plan or program, for the purpose of this rule, the Government of Nepal shall publish a notice in the Nepal Gazette dated 2060.2.1 and designate the following universities or educational institutions:-
(a) National Academy of Medical Sciences Veer Hospital, Kathmandu.
(b) Tri.V. Teaching Hospital Maharajganj, Kathmandu.
(c) VP Koirala Institute of Health Sciences, Dharan. During such training period he will be sent as a worker and he will be paid full salary during that period. But this type of work should only be for the purpose of training and no training work will be given to any employee when he is sent to acquire an academic degree.
